East Lothian Council Proposed Replacement Article 4 Direction
Overview
East Lothian Council is consulting on a proposed replacement Article 4 Direction under the Town and Country Planning (General Permitted Development Order) (Scotland) Order 1992, as amended.
This affects some very specific classes of development which, subject to approval by Scottish Ministers, would need planning permission if they are for a property or on land that is within a conservation area in East Lothian. These include proposals to install a flue to the exterior of a building; for means of enclosure for non residential properties; to require windows that are not the same on principle elevations of dwellings to need planning permission rather than to follow the prior notification process to determine whether planning permission is needed; the construction of a means of access for a road; the change of use of a building such as a shop or professional or other service to a class 4 business use; works within the boundaries of a private road; works by a local authority not exceeding £250,000 and works to harbours and piers and for water undertakings.
